Faux Florist Limited reserve the right to supplement and amend these Terms and Conditions from time to time. We will post any changes on the Website wherein it remains the responsibility of the Buyer/Customer to review the Terms and Conditions on each occasion they access the Faux Florist Limited Website. Changes will be effective immediately after the posting of such change(s).
These Terms and Conditions shall be deemed to include all other notices, policies, disclaimers and other terms contained in the Faux Florist Limited Website, provided that in the event of a conflict between any such other notices, policies, disclaimers and other terms, these Terms and Conditions shall prevail. If any of these Terms and Conditions are deemed to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
A person(s) who is not a party to the agreement between the Buyer/Customer and Faux Florist Limited has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any of the Terms and Conditions. However, this does not affect any right or remedy of such person which exists
apart from that Act.
Save in respect of fraudulent misrepresentation, this agreement (including any documents referred to herein) supersedes all prior representations, arrangements, understandings, and agreements between the said Buyer/Customer and Faux Florist Limited (whether written or oral) and sets out the entire agreement and understanding between the Buyer/Customer and Faux Florist Limited relating to the subject matter hereof.
The headings in these terms and Conditions are for ease of reference only any shall not affect the
interpretation and construction of the same.
Copyright / Intellectual Property
The copyright and other intellectual property rights in all content and material on this Website (including without limitation, the name "Faux Florist Limited", logos, trademarks, graphical images, photographs, product names and product descriptions) are owned by Faux Florist Limited or its licensors and protected by the international copyright and design right laws, unless otherwise stated or indicated. They may not be reproduced, distributed or modified in whole or part, without the prior written consent of Faux Florist Limited. All rights which are not expressly granted in these Terms and Conditions are reserved.

Faux Florist Limited use premium quality artificial flowers, greenery, trees and plants which are handmade and hand-finished.
Every endeavour is made by Faux Florist Limited to supply the Buyer/Customer with products of the highest quality and workmanship possible.
Faux Florist Limited’s goods/products are not sold on a trial, hire or loan basis.
Photographic Material
Every endeavour has been made to ensure that all of our photographic material gives the truest representation of featured products, images and quality as possible. Faux Florist Limited cannot guarantee that a Buyer/Customer’s electronic device i.e., computer, i-pad, mobile phone and other
such devices, will display our products in the same manner or likeness. Henceforth, Faux Florist Limited will not be held liable for any discrepancies in image conversion used by the said Buyer/Customer.
Buyers/Customers will be supplied with the truest representation of the photographically featured product as seen on our website.
Photographic material will often feature a suggested prop and/or environment to enhance images. Unless otherwise stated, pricing quoted is for an individual stem, plant, floral arrangement and/or plant display only.
Description
The description of Faux Florist Limited’s product(s) range i.e, stems, plants, floral arrangements and plant displays has been provided by way of a guideline(s) and general identification purposes only. The use of such descriptions shall not constitute sale by description.
Colouration
Faux Florist Limited product(s) can and/or may be subject to colour variation due to batch mixing and application techniques.
Every endeavour has been made to ensure that all of our photographic material gives as truer representation of colour and quality as possible. Faux Florist Limited cannot guarantee that a Buyer/Customer’s electronic device i.e., computer, i-pad, mobile phone and other such devices, will display colouration of our products in the same manner or likeness. Henceforth, Faux Florist Limited will not be held liable for any discrepancies in colour conversion used by the said Buyer/Customer.
Measurements
All measurements are approximate, given that each product is generally hand-made and will be subject to slight deviation and variation. If overall dimensions are critical to the Buyer/Customer’s purchase, please contact us to discuss your requirements.
Pricing
All prices are in UK pounds sterling. Faux Florist Limited reserves the right to change products and prices on the website when necessary without prior notice. However, any Buyer/Customer order accepted and ready for dispatch will be honoured at the original agreed purchase price.
VAT is payable on all products and sales. Faux Florist Limited reserves the right to adjust VAT charges of 20% as advised by HMRC without prior notice.
For EU Buyers/Customers able to provide a valid VAT number, please contact us prior to ordering, to see if qualification for VAT exemption is applicable.
Placing Your Order
When placing an order, the Buyer is consenting to be bound by our terms and conditions contained in these ‘Terms and Conditions’ and appearing elsewhere on the Faux Florist Limited Website.
An order to us is an offer in which Faux Florist Limited may or may not accept and will not be bound by a contract with the Buyer/Customer until and/or unless, we have received from the Buyer/Customer all the payment details we require for the goods ordered by the said
Buyer/Customer, the Buyer/Customer’s payment to us has been authorised by their card issuer and we have issued an email acknowledging the Buyer/Customer’s order.
Purchase Orders will not be processed, if full payment details are not received by us.
Purchase Orders placed on Saturdays, Sundays or Bank Holidays will be treated as having been received on the following working day.
A Purchase Order will be acknowledged via e-mail confirming the Buyer/Customer’s details, provided the Buyer/Customer has supplied us with a correct e-mail address. The Buyer/Customer will be provided with an order reference number via email for any future correspondence. All prices and charges will be calculated at the time the Buyer/Customer places their order.
For Purchase Orders to be processed and delivered as promptly as possible, the Buyer/Customer must supply us with all the relevant details we request, including full delivery details, postcode and telephone number(s).
Your purchase will be deemed to have occurred in England. These Terms and Conditions and the relevant contract between us shall be governed by and construed in accordance with English Law and the parties agree to submit to the exclusive jurisdiction of the English Courts.
Made To Order/Bespoke Items
Upon placing a Purchase Order, Faux Florist Limited shall send email confirmation of the same.
Faux Florist Limited will endeavour to process your Purchase Order by way of making/creating your specified Purchase Order to the highest standard and thereafter, deliver your purchase to you as promptly and as efficiently as possible via the best possible parcel delivery service available i.e, Postal Service, Courier and/or Shipping Companies etc.
Made To Order/Bespoke items are made/arranged/created and/or assembled specifically for the said Buyer/Customer upon their Purchase Order being placed and confirmed.
Made To Order/Bespoke items are not pre-made, assembled or pre-packaged to ensure quality control requirements are adhered to at all times and that each order is processed with the highest standard of merchandise and workmanship.
Made To Order/Bespoke items require payment in full. Please note Made To Order/Bespoke items and are non-refundable and non-exchangeable (unless faulty) upon the said Buyer/Customer placing their Purchase Order.
Made To Order/Bespoke items include, but are not limited to, floral arrangements, potted interior trees, potted interior plants, potted cactus and succulent displays, potted exterior trees and exterior potted plants.
Discount Offers
Product offers at discounted prices are valid from the time that Faux Florist Limited introduce them to the end date of the offer and they cannot be used for purchases before the offer introduction date or after the offer end date.
We are unable to offer special discounts for purchases that have already been made. As our special offers are often made available due to the availability of products, we may change the terms of special offers, or withdraw them altogether, at any time and without prior notice.
We also reserve the right to offer different personalised special offers and promotions and it will therefore, only be possible for the Customer in receipt of the special offer to redeem the discount.
Cancellation Policy
Buyers/Customers who wish to cancel their order with us are permitted to do so provided we are notified within 24 hours of the same and/or their order has not been dispatched. A full refund will thereafter be issued.
For Buyer/Customer orders already dispatched, the Buyer/Customer is liable for returning the goods to Faux Florist Limited in the same condition and packaging in which their goods were sent. Please note, the Buyer/Customer shall be liable for any additional returns costs, surcharge and/or expenses.
A full refund will only be issued once the Buyer/Customer has returned their goods to Faux Florist Limited in the same condition and packaging.
Payment
Payment can be made by any of the methods indicated on the payment page of the Faux Florist Limited website i.e, major credit cards and/or bank transfer, wherein the Buyer/Customer will be debited upon submitting their order.
Occasionally, credit cards that are entered correctly and have sufficient funds are not necessarily validated due to the card issuer performing a random security check. In such cases, the Buyer/Customer may be required to pay via telephone. Faux Florist Limited will email and/or
telephone the Buyer/Customer in these circumstances. If the Buyer/Customer receives a message stating that payment has not been validated, the Buyer/Customer should contact us immediately to ensure their order can be processed.
Please note we are sometimes unable to process a valid payment for Buyer/Customer orders due to varying circumstances i.e., differences in time zones, payments that are made out of office hours, issues with regard to the contact details a Buyer/Customer has provided us with etc. Should this
occur, we will endeavour to contact the Buyer/Customer via email and/or telephone. Thereafter, once we have received payment, we shall process and dispatch the Buyer/Customer’s order as soon as possible to minimise any further delay. Although such delays are regrettable, they are unfortunately, outside of our control. Faux Florist Limited cannot offer any form of refund/compensation in these circumstances.
Faux Florist Limited may request via its website and/or via telephone, that Buyers/Customers supply personal details and/or credit card details in order to receive goods or services from us. Where appropriate, such requests operate over secure connections so that data is safeguarded. By supplying such information, the Buyer/Customer consents to Faux Florist Limited storing the information provided for a period of time appropriate to the supply of the goods or services requested. Personal information provided will only be used for the purpose stated and will not be sold, licensed or traded to any third parties. Personal information collected and/or processed by Faux Florist Limited is held in accordance with the provisions of the Data Protection Act 2018.
All products/goods are and will remain the property of Faux Florist Limited until they have been paid for in full.
Made To Order/Bespoke
Any requested changes for Made To Order/Bespoke items will only be permitted subject to a minimum of 24 hours’ notice being given in writing via email pursuant to the order being placed by the Buyer/Customer. Please note, Faux Florist Limited cannot guarantee acceptance of any changes for the Buyer’s/Customer’s order after such time. Faux Florist Limited’s acceptance of any requested change(s) to the Buyer’s/Customer’s order may affect the price to be paid by the said Buyer/Customer.
Buyers/Customers who wish to make any cancellations to their order are required to contact us in writing via email and/or telephone within 24 hours. Any cancellations(s) to a Buyer’s/Customer’s order may affect the price to be paid by the said Buyer/Customer.
Only requests for cancellations that are made within 24 hours subsequent to the Buyer/Customer placing their order will be considered by us. Although we will usually accept such a cancellation, we do not guarantee to do so on every occasion. Where a requested cancellation is received by us on a Saturday, Sunday or Bank Holiday, it will be treated as having been received on the following working day.
UK Delivery
Faux Florist Limited aim to deliver your order as promptly, safely and efficiently as possible. Faux Florist Limited use reputable couriers for delivery.
The Buyer/Customer shall be responsible for providing an accurate and complete delivery address when processing Purchase Orders and for ensuring the delivery address is accessible for our courier drivers.
Delivery times stipulated are estimated guidelines only and cannot be guaranteed. Faux Florist Limited will not be held liable for any circumstances outside its control i.e., traffic delays and/or failures etc.
Please note, due to changing Covid restrictions, any timeframes given can and/or may be affected due to circumstances beyond our control.
All Buyer/Customer deliveries will require a Recipient signature.
Upon delivery being attempted by our courier, please note that should the Buyer/Customer and/or someone other than the Buyer/Customer appointed by the said Buyer/Customer to receive the delivery and not be at the said address, a calling-card will therefore, be left stating an attempted delivery was made. Thereafter, should re-delivery be required, all costs shall be borne by the Buyer/Customer for all said parcel(s)/package(s).
Should a Buyer/Customer leave a signed note for the courier stipulating their goods should be left in a safe place/location, the Buyer/Customer will bear full responsibility at their own risk for any theft, loss and/or damage of their goods.
Faux Florist Limited and all courier companies used, take no responsibility for goods that are not checked or signed for at the said time of delivery.

International & Non Mainland Delivery
Faux Florist Limited aim to dispatch orders within 14 days, pursuant to the Buyer/Customer placing their order(s).
The Buyer/Customer shall be responsible for providing an accurate and complete delivery address when processing Purchase Orders and for ensuring the delivery address is accessible for our courier drivers/delivery company partners.
Delivery times stipulated are estimated guidelines only and cannot be guaranteed. Faux Florist Limited will not be held liable for any circumstances outside its control i.e., traffic/flight/shipping delays and/or failures etc.
Delivery costs are subject to the weight and size of your order. Please note, any customs, local taxes and/or import duties levied shall be borne solely by the Buyer/Customer.
Failed Deliveries
The Buyer/Customer shall be responsible for providing an accurate and complete delivery address and for ensuring the delivery address is accessible for our courier drivers/delivery company partners.
Should any item(s) be returned to us due to an incorrect delivery address being supplied by the Buyer/Customer and/or the courier/delivery company is not able to complete the delivery due to inaccessibility or no Recipient being at the delivery address, Faux Florist Limited reserves the right to charge an additional delivery cost to re-deliver the parcel(s)/package(s) which shall be borne by the Buyer/Customer.
Stock Availability
All products are subject to availability and acceptance of the Buyer’s/Customer’s order. In the event of any supply difficulties and/or if the products/goods we have received from our suppliers that are needed to make up the Buyer’s/Customer’s order do not meet our standards of quality control, we reserve the right to substitute an alternative product(s) of a similar style and equivalent (or greater) value and quality.
Where substitution of goods is necessary, we will endeavour to contact the said Buyer/Customer in advance via email and/or telephone. If we are unable to reach the Buyer/Customer via the contact methods provided prior to the time that we create/make up the Buyer’s/Customer’s order, we will assume that the said Buyer/Customer accepts the substitution.

Force Majeure
Neither we, nor any courier, postal service and/or delivery company partner that we use, shall be liable for any failure or delay in performance where such failure or delay results from any circumstances outside our reasonable control, including, but not limited to, any fire, flood, explosion, accident, adverse weather conditions, traffic congestion, mechanical breakdown, obstruction of any private or public highway, riot, government act, act of war, terrorism, Act of God, or from any industrial dispute or strike whatsoever.
Third-Party Messages
The Buyer/Customer must agree that any messages they provide/send to Faux Florist Limited which the Buyer/Customer requests Faux Florist Limited to send to a third party by us on behalf of the Buyer/Customer, will not contain anything which could be construed as harassing, threatening, vulgar, abusive, obscene, defamatory, racist or which may cause embarrassment, alarm or distress to any person or are otherwise is unlawful or objectionable.
The Buyer/Customer is entirely responsible for any such message(s) and we accept no liability whatsoever for any such content. Faux Florist Limited does not routinely screen messages, but may monitor content from time to time. Faux Florist Limited have the right to refuse to send and/or display
messages on behalf of the Buyer/Customer and shall terminate the Buyer’s/Customer’s access to the relevant services at any time without liability in the event that any message(s) seems to us to be objectionable.
Promotions
From time to time Faux Florist Limited may feature Promotional Offers, the terms of which are entirely at its sole discretion.
Promotional Offers may have different terms and conditions. Please contact us if you require detailed information about a particular Promotional Offer.
Promotional Offers can only be redeemed on full price items.
Promotional Offers are restricted to one per Buyer/Customer.
A minimum spend may be applicable to selective Promotional Offers.
Personal Information
To ensure that Faux Florist Limited can communicate effectively with both Buyers, Customers and Recipients, it is very important that the Buyer/Customer provide(s) accurate personal information. Please remember that Faux Florist Limited, value your privacy and will never lease, rent or sell your private information. For more information, please see our Privacy Policy.
We shall only use personal data received from you for the purpose of fulfilling our obligations under these Terms and Conditions and as stated in our Privacy Policy.
Damaged Goods
Although Faux Florist Limited take great care in packing all purchase orders, in the rare and unlikely event that goods arrive damaged, the Buyer/Customer should refuse delivery after first checking that the interior contents of the package(s) has been damaged and/or visibly affected.
If damaged goods are received, the Buyer/Customer should contact Faux Florist Limited within 48 hours via email at: info@fauxflorist.co.uk or telephone, so this matter can be rectified as soon as possible.
RETURNS POLICY
Non Made To Order/Bespoke Orders
If the Buyer/Customer is not completely satisfied with their goods (excludes Made To Order/Bespoke orders), please notify us via email at: info@fauxflorist.co.uk within 14 days of receipt The Buyer/Customer should ensure they return the product(s) to us unused, in its original packaging with any tamper seals intact. The Buyer/Customer will be entitled to a refund and/or replacement to the equivalent value if the returned product(s) reach us within 14 days of the cancellation notification (Consumer Protection (Distance Selling) Regulations 2000). The Buyer/Customer should ensure that returned goods are packaged and labelled carefully to Faux Florist Limited, so that goods are not lost and/or damaged in transit.

Replacements for exchange of damaged goods will not be dispatched until the original product(s) have been received by us.
PLEASE NOTE, FAUX FLORIST LIMITED CANNOT REFUND OR EXCHANGE ANY ARTIFICIAL FLOWERS, PLANTS OR STEMS THAT HAVE BEEN CUT/SHORTENED OR DAMAGED BY THE BUYER/CUSTOMER.
This does not affect your statutory rights.
Heavy goods items (e.g. planters, containers etc.) can be rejected by the Buyer/Customer or Recipient and/or returned/taken away at the point of delivery free of charge.
If the Buyer/Customer subsequently decides to return the product(s) after delivery has taken place a collection fee will be incurred and deducted off the Buyer’s/Customer’s refund. Please note, collection may take up to 28 days (40 days for more remote areas).
To arrange the returns of heavy goods, please contact Faux Florist Limited at info@fauxflorist.co.uk as soon as possible.
Variation
Neither the Buyer/Customer, nor Faux Florist Limited shall be bound by any variation, waiver of, nor addition to these conditions except as agreed by both parties in writing and signed on their behalf.
Limitations & Exclusions
Faux Florist Limited endeavours to ensure that this Website and/or the services it provides are fully operational and error-free. Faux Florist Limited cannot guarantee nor accept any responsibility for any errors, defects and/or interruption of the Faux Florist Limited Website or Services.
